This blogs-becoming-magazines thing is catching on: first Engadget Distro, and now fellow tech site TheNextWeb has launched a "digital monthly magazine" for iPad. It rounds up content from the site with additional columns, photography and interactivity. TNW used the Mag+ platform to create the app.

SprintTV for iOS

By definition a US-focused app, this offers live TV to iPhone-owning customers of mobile operator Sprint. Channels include ESPN, NBC News, Disney Channel and others. Additional packs of channels can be subscribed to in-app for between $4.99 and $9.99 per bundle. A sign that operators haven't given up on their mobile TV ambitions.

Motorola wins injunction against Apple, could spell trouble for EU sales


Motorola Mobility on Thursday won an important injunction against Apple in Germany, which could potentially bar Apple's European sales arm from selling iPhones and 3G-equipped iPads. At issue is a Motorola patent for cellular data transmission, part of wireless data transmission standards that are encumbered by an agreement to license the patent on "fair, reasonable, and non-discriminatory" terms. The ruling suggests that, at least in Germany, raising a FRAND defense against standards-essential patent infringement claims could be a difficult proposition, and may force Apple to accept Motorola's licensing terms—FRAND or not—for "past infringement."
The FRAND defense has worked for Apple elsewhere, including in lawsuits brought by Samsung in The Netherlands and France. The basic argument is that suing over standards-essential patents instead of working out a FRAND agreement amounts to violation of anti-competition laws. Without some legal barrier to suing over such patents, they could potentially be used as a club to thwart any would-be competitors once they have built products incorporating a particular technology standard.
The European patent in suit, EP1010336 (B1) "Method for Performing a Countdown Function During a Mobile-Originated Transfer for a Packet Radio System," is part of the General Packet Radio Service standard upon which 2G and 3G data services operate. Basically, that means that all Apple products that use 3G data—including all iPhones and all 3G-capable iPads—use the patented technology.
Motorola claims that it approached Apple in 2007, after the launch of the original iPhone, to license this and other standards essential patents for FRAND terms. "We have been negotiating with Apple and offering them reasonable licensing terms and conditions since 2007," Scott Offer, senior vice president and general counsel of Motorola Mobility, said in a statement e-mailed to Ars.
Apple apparently didn't consider the terms very fair, and the issue spilled into the courts in October last year, with Motorola filing lawsuits and ITC complaints against Apple over 18 patents. Motorola also filed three separate patent infringement suits in Germany over related European patents, including the patent at issue.
(In Apple's ongoing legal war over Android, Apple has likewise filed patent infringement suits aimed at Motorola's Android-based smartphones.)
In Germany, however, a legal precedent has established that a FRAND defense can only be used under certain conditions. Namely, a company must have made an offer to license the patents in question on FRAND terms and posted a bond for expected future royalties. If a patent holder then refuses the offer and sues, the FRAND defense can be used.
Apple apparently made an offer to license the patent on FRAND terms going forward. But the matter wascomplicated by the fact that Apple's agreement included a clause that would allow it to try and have the patent invalidated if Motorola tried to seek damages for past infringement over and above the agreed FRAND rate.
Apple is in fact contesting the validity of the patent in suit in another federal court in Germany. Obviously it doesn't want to have to pay for infringing a patent that might not be valid.
Unfortunately, the issue of past infringement of standards-essential patents hasn't previously been addressed in the relevant cases in Germany. As Motorola's legal team successfully argued, if a patent is infringed without a valid license, there should be some punishment in the form of monetary compensation. While competition law may require patent holders to honor FRAND agreements and offer a license going forward, the court agreed that past infringement should be treated differently.
The issue of past infringement gave Motorola a valid reason to reject Apple's FRAND license offer, according to the court, and for that reason it granted the injunction against Apple.
"We are pleased with the court's ruling," Offer said. "Today's decision validates Motorola Mobility's efforts to enforce its patents against Apple's infringement."
Since Apple is contesting the validity of Motorola's patent, it seems likely Apple will appeal the ruling. It may be able to have the injunction stayed until a decision on the appeal is reached. If the injunction remains in force, however, Apple may have to give in to Motorola's demands for damages.
Motorola, for its part, suggested it was willing to make a deal. "We will continue our efforts to resolve our global patent dispute as soon as practicable," Offer said.
UPDATE: Unsurprisingly, Apple will definitely appeal the ruling, according to a statement given to All Things D. "We're going to appeal the court's ruling right away," an Apple spokesperson said.
The company also seems confident that it can get an appeals court to stay the injunction—or at least avoid enforcement for the next couple weeks. "Holiday shoppers in Germany should have no problem finding the iPad or iPhone they want," the spokesperson said.more information...

iPhone fanboys depicted as fad following sheep in new Samsung ad


A new Samsung commercial depicts Apple fanboys as fad following sheep who care more about image than functionality.

Apple critics like to frequently point out that Apple's success is largely attributable to passing fads. Of course, this argument carried more weight when we were still in the iPod era. But now that Apple has followed up the success of the iPod with the iPhone and iPad, it's hard to really argue that Apple's success is the result of anything other than sleek hardware coupled with intuitive software.
Nonetheless, Samsung last week released a commercial attempting to portray iPhone users as followers who care more about status than what a device can do. Purporting to show Apple fanboys waiting in line for some new product release, the commercial below depicts prospective iPhone owners as caring more about image than anything else. And despite it all, the commercial is actually quite funny.
At one point, a hipster looking dude dismissively states, "I could never own an Android, I'm creative", to which his friend exclaims, "Dude! You're a barrista!"
Apple pundits may like to think otherwise, but Apple fans genuinely like Apple products for the right reasons. Which is exactly why we can take a look at commercials like these and have a hearty laugh.

Entire Computer Built Into USB Thumb Drive

Is that a USB key in your pocket or a dual-core computer? 

Norwegian company FXI Technologies showed off an amazing USB stick-sized portable computer prototype on Friday, Nov. 18. Code-named Cotton Candy because its 21 gram weight is the same as a bag of the confection, the tiny PC enables what its inventor calls "any-screen computing": the ability to turn any TV, laptop, phone, tablet, or set-top box into a dumb terminal for its Android-powered operating system.

Packed in its tiny  body is a dual-core 1.2-GHz Samsung Exynos ARM CPU (the same processor as in the Galaxy S II), 802.11n Wi-Fi, Bluetooth, HDMI-out and even a microSD card slot for memory. 

The Cotton Candy has a USB 2.0 connector on one end and an HDMI jack on the other. When connected to an HDTV, it uses the HDMI-out port for video, the USB for power, and Bluetooth to connect to a keyboard, mouse, or tablet for controlling the operating system. 
The device can output up to 1080p so even a full HD screen can display the Candy's preloaded Android 2.3 operating system at its native resolution. The dual core CPU is powerful enough to play local 1080p video or stream HD clips from the Web.
When you plug the Cotton Candy into a Mac or PC, the Windows or OS X operating system recognizes it as a USB drive. You can then launch the software and run the Cotton Candy's Android environment in a secure window while you use your desktop OS outside the window. You can even transfer files between your notebook's native OS and the Cotton Candy's Android environment by dragging them off or on the USB stick's memory. 
We watched as FXI CEO Borgar Ljosland popped the Cotton Candy into his MacBook Pro and, within seconds, had the device's Android OS running in a full screen window and, though we didn't get to play with the device ourselves, we were impressed with how quickly it started up. Borgar told us that Android developers can use this environment to test out their apps while they work on code in another window. 
HDTVs, monitors, and computers are just the tip of the iceberg for the Cotton Candy. Borgar told us the device will be able to connect to tablets, smartphones, and even set top boxes via USB or Bluetooth. He says that he expects the device to be able to turn even an iPhone or an iPad into a terminal for its environment. Imagine an iPhone running Android!
Because the Cotton Candy is a full-fledged computer, it should be able to plug into a USB hub and connect directly to a monitor, keyboard, and mouse to launch its OS. Offices or schools could set up docking terminals to support users who carry it in their pockets. 
Cotton Candy's purpose is to provide a computing experience that users can carry with them and replicate anywhere they go. Imagine walking into an Internet cafe or a business center, popping your Cotton Candy into a USB port, and having your own operating system and applications take over the device.
Though the current prototype runs Android 2.3, Borgar told us that the ARM-based hardware can run Ubuntu Linux currently and future versions should be able to run the ARM version of Windows 8. Future versions of the device will have a USB 3 connector and faster processors.
From developers to students to mobile workers, there are a number of groups that could find innovative ways to use a computer the size of a USB stick. However, you won't see a consumer product shipping anytime soon from FXI. The company plans to sell the Cotton Candy to developers and let OEMs license the technology and turn it into something that can appeal to a wide audience.
Borgar does not expect these future "any screen" products to replace your primary PC or smartphone, but says they could become popular secondary devices. With Ubuntu installed, the Cotton Candy can even be turned into a mobile file or web server!
FXI hasn't set pricing yet for the Cotton Candy, but expects it to cost considerably less than $200 per unit. That's not bad for a full-fledged computing device the size of a cigarette lighter.more information...
